By accessing or using PermitStacker ("Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Service Description

PermitStacker provides automated permit lead tracking and delivery services by aggregating publicly available building permit data from various county and municipal portals. We deliver this information via daily email digests to paid subscribers.

3. Disclaimer of Warranties

THE SERVICES AND ALL DATA, LEADS, OR INFORMATION PROVIDED THROUGH THE PLATFORM ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the maximum extent permitted by law, we explicitly disclaim any warranties of merchantability, fitness for a particular purpose, quiet enjoyment, or non-infringement, as well as any warranties arising out of the course of dealing or usage of trade.

We make no warranty that:

  • The leads provided will be accurate, complete, current, or error-free
  • The service will be uninterrupted, timely, secure, or available at any particular time or location
  • Any defects or errors will be corrected
  • The data will meet your specific business requirements or result in any business opportunities
  • Third-party county portals will remain accessible or operational

You acknowledge that permit data is sourced from third-party government portals which may contain errors, omissions, or delays. We do not guarantee the accuracy or completeness of any permit information.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PERMITSTACKER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or information
  • Cost of procurement of substitute services
  • Business interruption
  • Missed bids or contract opportunities
  • Wasted time, materials, or labor costs

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING UNDER THESE TERMS EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO US FOR THE SPECIFIC SERVICES GIVING RISE TO THE CLAIM DURING THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO LIABILITY.

These limitations shall apply regardless of whether the liability is based on contract, tort (including negligence), strict liability, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

5. Subscription and Billing

All subscriptions are billed annually in advance. Prices are stated in US Dollars. By subscribing, you authorize us to charge your payment method for the subscription fee.

Refund Policy: All sales are final. No refunds will be provided for partial subscription periods or for any reason related to data quality, timeliness, or completeness.

6. Data Usage and Restrictions

The permit lead data provided is for your internal business use only. You may not:

  • Resell, redistribute, or share the data with third parties
  • Use the data for any illegal purpose
  • Attempt to reverse engineer or scrape our platform
  • Access the service through automated means other than our provided delivery methods

7. Cancellation

You may cancel your subscription at any time through your account settings or by contacting support. Cancellations take effect at the end of the current billing period. No refunds will be provided for the remaining subscription period.

8. Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, including the availability of any county, feature, database, or content, with or without notice and without liability.

9. User Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Independently verifying any permit information before acting on it
  • Ensuring compliance with all applicable laws and regulations in your use of the data

10. Indemnification

You agree to indemnify, defend, and hold harmless PermitStacker and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of or related to your use of the Service or violation of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right to update these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
